Intra-company transfer (ICT): authorisation and TIE in Spain
If your company is moving someone from another office in the same group to Spain (executive, specialist or trainee), this is where you apply for the Migraciones authorisation (Ley 14/2013) and then the TIE at the Policía. Valid for companies moving staff within the same corporate group.

- Tasa 038 (Ley 14/2013) paid by the company.
- For the TIE: EX-17, tasa 790-012, photo and, depending on comisaría, padrón.
Step by step
- Submit the ICT authorisation at the Sede de Migraciones (UGE-CE) on behalf of the company. Upload all documents and keep the acknowledgement.
- Pay tasa 038 and attach the receipt. Without it the file is incomplete.
- Wait for the resolution (legal term 20 days; silencio positivo). If they request corrections, reply within the deadline.
- If the worker is abroad, with the concession ask for the ICT visa at the relevant consulate. Check local consulate requirements (they vary by country).
- Entry to Spain and registration with Seguridad Social by the company (before starting work).
- Fingerprint appointment (TIE): book the appointment, pay 790-012, bring EX-17, passport, resolution/visa, photo and padrón if requested.
- Collect the TIE when the comisaría tells you (usual 3–6 weeks). Bring the receipt and passport.
Tips that save time
- Upload clear, complete PDFs; no blurry photos: they’ll ask for corrections and you lose weeks.
- Detailed secondment letter: duties, salary and duration. Avoid vague wording.
- Fingerprint appointments: try very early slots or overnight releases; change comisaría if your city is saturated.
- Family at the same time: process family members as ICT dependants in parallel to enter together.
- Silencio positivo: if 20 working days pass, request a certificate of silencio positivo and use it for visa/registration.
Common mistakes to avoid
- Confusing national ICT with ICT-UE: you may lose EU mobility and have to reapply.
- Not paying tasa 038 or attaching it incorrectly: file stalls.
- Criminal records without apostille/translation: certain rejection or correction request.
- Missing the 1-month deadline for the TIE: sanction and border headaches.
- Insufficient insurance if there’s no SS registration yet: the consulate may refuse the visa.
- Salary below market for the role: Migraciones will question it; justify the role and conditions clearly.

- 5.Fill in and pay tasa 790-012 online or at a bank: https://sede.policia.gob.es/Tasa790_012/
- 6.Attend the appointment with EX-17, passport, resolution/visa, photo, padrón (if required) and the tasa 790-012 receipt; they take fingerprints and give you a receipt to collect the TIE
- 7.Collect the TIE at the same comisaría when they notify you (usually takes 3–6 weeks; bring the receipt and your passport)
- Full passport of the worker (all valid pages, copy)
- Company secondment letter with position, salary, duration and conditions
- Proof of the corporate group and link between origin and destination (escrituras, organigrama, participaciones)
- Worker’s degrees and/or experience proving executive/specialist profile or training plan (if a trainee)
- Health insurance with coverage in Spain (if there is no Seguridad Social registration on arrival)
- Certificado de antecedentes penales of the country of residence for the last 5 years (legalised/apostilled and, if applicable, translated)
- Receipt of payment of tasa 038 (Ley 14/2013) by the company
- For fingerprints: formulario EX-17, passport photo (ID size), receipt for tasa 790-012 and padrón if your comisaría asks for it
Fingerprint deadline
You have 1 month from entry into Spain or from the concession date (if you were already here) to request the TIE. Missing the deadline can mean a sanction (100–500€) and issues at borders.
Silencio positivo
The UGE-CE has 20 days to decide. If they don’t respond, silencio positivo (silent approval) applies. Still, keep the submission receipt and the acknowledgement to prove it.
ICT UE vs national ICT
Don’t mix up the ICT-UE authorisation (allows some mobility within the EU) with the national ICT. If you plan to move to other EU countries, apply for the correct modality.
Fingerprint appointments
Appointments disappear fast and some comisarías only release slots very early or at odd hours. Retry several times and use a desktop browser.
Can I bring my partner and children with the transfer?
Yes. They are processed jointly or afterwards as family members of the ICT holder (Ley 14/2013). You’ll need marriage/partnership and birth certificates, legalised/apostilled and translated if required.
When can I start working?
You can work once the authorisation is granted and the company registers you with Seguridad Social; the visa allows entry. You don’t need to wait for the physical TIE if you are already registered.
Can I switch to a different company outside the group?
Not under the ICT. It’s tied to the corporate group. To move outside the group you’ll need a different authorisation (e.g., highly qualified professional).
What if I don’t get the TIE within the month?
That’s sanctionable (minor offence) and complicates travel and other procedures. Book the appointment ASAP and keep screenshots if there are no slots to justify delay.
Do I need to homologate my degree?
Generally no, unless it’s a regulated profession. It’s enough to prove qualification/experience for the executive or specialist role, or the training plan if you come as a trainee.
Is this cheaper if I already have a NIE?
No. You still pay tasa 790-012 for the card and tasa 038 for the authorisation. Having a prior NIE doesn’t waive fees.
Can I move to other EU countries with this authorisation?
Only if you have ICT-UE and meet the mobility conditions. National ICT does not allow it. Check the modality stated in your resolution.
