Step by step
- Download the form from the Ministerio de Justicia website and read the requirements carefully.
- Fill and sign, ticking the authorisation to check data (saves you time getting certificates).
- Book a cita at the SOJ of your Colegio de Abogados or submit it at their registro. If you’re tight on time, hand it in at the Decanato or Juzgado de Guardia with your citación.
- Deliver everything and keep the resguardo/registro. If your CCAA has a sede electrónica, file online with Cl@ve.
- Provisional assignment: if it’s urgent, they’ll appoint an abogado/procurador so the process keeps going.
- Resolution by the regional Comisión in a few weeks. They’ll notify you by letter or via DEHú.
Tips that save time
- Authorise data checks: avoids days lost getting AEAT/TGSS certificates.
- Recent documents: empadronamiento, balances and movements less than 3 months old.
- Bring copies and originals for verification. If you file online, legible PDFs and one PDF per document.
- Explain the case and attach the citación: speeds up provisional assignment.
- Give a phone number and email you use. Check DEHú if you registered.
Common mistakes that can derail the process
- Not attaching income proof (or not authorising checks): almost guaranteed denial.
- Forgetting accounts of other family members you live with: they check everything for the unidad familiar.
- Expired empadronamiento: dismissed on formal grounds.
- Applying too late when a hearing is already set: you’ll be stressed and may face provisional fees.
- Not reporting income improvements within 3 years: surprises later with repayment claims.

- 3.Book a cita at the Servicio de Orientación Jurídica (SOJ) of the Colegio de Abogados in your province or submit the application and annexes at their registro. If you already have a court date, you can also hand it in at the Decanato de los Juzgados or at the Juzgado de Guardia.
- 4.If your comunidad allows online processing, file the application with Cl@ve / certificado in their sede electrónica; if not, deliver it in person and keep the resguardo. Keep the expediente number.
- 5.They can appoint a provisional abogado and procurador so the procedure doesn’t stop. The Comisión de Asistencia Jurídica Gratuita of your comunidad will review the file and issue a resolution. Watch for notifications (DEHú: https://dehu.redsara.es).
- 6.You get the resolution: if granted, confirm with the assigned abogado/procurador; if denied or partial, consider appealing before the Comisión or the judicial body within the deadline stated in the notification.

Urgencies and short deadlines
If you already have a citación or it’s urgent, file the application straight away: they can appoint a provisional abogado/procurador in a few days. The Comisión usually resolves in around 30 days.
They can claim money back if your income changes
If in the next 3 years your financial situation improves significantly, they can review your right and demand full or partial repayment. You’re obliged to report changes.
No paperwork, likely denial
Not providing IRPF/AEAT documents, vida laboral or bank balances is the top reason for denial. Authorise data checks and bring recent certificates.
Watch out for costas
AJG covers fees, deposits and professional fees according to the scales, but if you’re ordered to pay costas and your right wasn’t recognised or is revoked, you’ll be on the hook.

Can I apply if I work?
Yes. It’s not about whether you work, it’s about income and assets versus the IPREM and your unidad familiar. If you don’t exceed the limits and the case qualifies, you’ll get it.
What exactly does it cover?
Court‑appointed abogado and procurador, court fees and deposits, expert reports if needed, and reductions in notarial/registry fees linked to the procedure.
Can I choose the court‑appointed lawyer?
They assign someone from the turno. You can propose a lawyer if they’re on the turno and accept. If you’re unhappy, you can request a motivated substitution, but it’s not automatic.
How long until they answer?
Typical: 2–6 weeks. If there’s a hearing or urgency, they’ll assign provisionally fast so the case doesn’t stop. The Comisión issues the definitive resolution.
What if they deny it?
You can challenge the denial before the Comisión or a judicial body within the deadline on the notification. If they had already assigned provisionally, you might be charged fees later.
Does it cover administrative issues or fines?
Yes, for contencioso‑administrative litigation. For purely administrative procedures (without court) it usually doesn’t cover, except compulsory preliminary steps tied to litigation.
