Change of name and/or surnames in the Registro Civil

What you need to have ready

1. Clear reason for the change: habitual use, swap surnames, linguistic adaptation (Basque, Galician, Catalan), translation of the name, recovery of a family surname…
2. Updated address: the Registro Civil that applies is the one where you are empadronado.
3. Patience: it isn’t instant. Between appointments, reports and entry annotation, expect a month (or three).

Documentation

1. DNI/NIE o pasaporte (original y copia).
2. Certificación literal de nacimiento reciente. If your RC is in DICIREG, they see it; if not, request it beforehand.
3. Certificado de empadronamiento reciente.
4. Escrito de solicitud with: personal details, the exact change you request and the legal reason.
5. Proofs of habitual use (if applicable): pay slips, enrolments, contracts, degrees, tarjeta sanitaria, official admin or school emails, etc.
6. Consents: from the other parent and the minor (≥12) if it affects children.
7. Certificates of parents/grandparents if you’re going to recover/apply a family surname.

Step by step

1. Confirm the legal fit for your case (habitual use, surname order, adaptation). General info: https://www.mjusticia.gob.es/es/ciudadanos/registro-civil
2. Book an appointment at your Registro Civil. Some offices use the Ministerio web; others have their own page/phone.
3. Write the request: “Solicito el cambio de … por …, por el motivo …, adjunto pruebas …”. Bring originals and copies.
4. Submit the request on the appointment day. They’ll register it and give you proof (CSV if they use DICIREG, stamp if on paper).
5. Internal processing: they may ask for a Ministerio Fiscal report (if there are minors) or more evidence. If something’s missing, they’ll request it.
6. Resolution and entry: if favourable, they record the change in your birth entry. Ask for an updated certificación literal.
7. Update documents: DNI/pasaporte (https://www.citapreviadnie.es), driving licence (https://sede.dgt.gob.es), Social Security (https://importass.seg-social.es), AEAT (https://sede.agenciatributaria.gob.es), banks and others.

Quick tips that save time

• Collect evidence covering several years if you’re claiming habitual use. The more official and varied, the better.
• Bring the written request already printed and a copy of everything. Some offices scan, some don’t.
• If you want the change to affect your children, ask in the same file and bring their certificates and consents.
• If your RC isn’t in DICIREG, request the certificación literal with a few days’ margin: it sometimes takes time.

Common mistakes that will mess up the process

• Going without a solid legal reason: “because I like it more” alone is often refused.
• Not providing proof of habitual use: no papers, no case.
• Forgetting consents when minors are involved: leads to delays and formal requests.
• Assuming it’s immediate: until it’s annotated in your birth entry, they won’t renew DNI/pasaporte with the new name.
• Paying third parties to ‘speed it up’: there’s no tasa and nobody speeds it up legally outside the official circuit.
