What you need to have ready
  1. Decision: separación, gananciales or participación. 2) IDs: DNI/NIE/passports. 3) Registration details of the marriage (or número de expediente matrimonial if you haven’t married yet). 4) Cl@ve or digital certificate to file online if the notary doesn’t send it.

  • Escritura pública de capitulaciones (authorized copy). If foreign: apostilla and sworn translation.
  • DNI/NIE of both.
  • Certificado literal de matrimonio if already registered.
  • Registro Civil details (municipio, tomo, página) or old Libro de Familia if you keep it.
  • Número de expediente matrimonial if they are prenuptial.
  • Poder notarial if a third party files.
Step by step
  1. Signature at the notary: explain the regime and the terms. The notary drafts it and you sign. If you change regime you may or may not liquidate gananciales at the same time.
  2. Sending to the Registro: ask the notary for remisión telemática via DICIREG. That’s fastest.
  3. If they don’t send it, upload it yourself via the REC with Cl@ve at https://rec.redsara.es/registro/action/are/acceso.do. Recipient: Ministerio de Justicia – Registro Civil de [tu municipio]. Subject: Anotación de capitulaciones matrimoniales. Attach the copia autorizada (PDF signed by the notary) and a short covering letter with your details and the marriage entry.
  4. In person (alternative): deliver the copia autorizada at the competent Registro Civil office. Check contact/hours at https://sede.mjusticia.gob.es. Ask for a receipt.
  5. Follow-up: in 1–4 semanas they should make the note. Request an updated certificado literal de matrimonio to confirm the marginal annotation (via the sede or your Registro Civil).
Time-savers
  • Telematic or nothing: insist the notary sends it electronically. You’ll avoid queues and lost papers.
  • Bring the marriage entry details (tomo/página) by hand: it speeds up the Registry search.
  • If a mortgage is near, tell the bank it’s “in process” and show proof of submission.
  • For foral territories: if you’re from Cataluña, Aragón, Navarra, País Vasco, Baleares or Galicia, confirm with the notary the régimen supletorio and applicable law so you don’t mess it up.
Common mistakes to avoid
  1. Assuming signing at the notary is enough: without inscripción it’s not enforceable against third parties.
  2. Uploading a simple scan to the REC: it must be a copia autorizada electrónica or you must present a paper copia autorizada at the Registro.
  3. Forgetting the apostilla/translation for foreign deeds: they’ll reject it and you’ll have to start again.
  4. Filing at the wrong Registro: it must be noted in the Registro Civil of the marriage (or expediente). Wrong office causes delays and remissions.
  5. Hidden debts: changing regime to “hide” assets doesn’t work; creditors can attack the change.
  1. 1.Go to a notary and sign the escritura de capitulaciones. Choose the regime: separación, gananciales or participación. Take your DNI/NIE and the other person’s. Explain exactly what you agree.
  2. 2.Ask the notary to send the escritura to the Registro Civil electronically via DICIREG. If they do, you avoid extra trips. If not, get an authorized copy in PDF with electronic signature or a paper copy.
  3. 3.If the notary DOES NOT send it, you file the authorized copy at the Registro Civil yourself: log in with Cl@ve or certificate to the Registro Electrónico Común (REC) at https://rec.redsara.es/registro/action/are/acceso.do, attach the escritura and address the submission to the Registro Civil where your marriage is registered or where your expediente is being processed.
  4. 4.If you prefer in person, hand the authorized copy at the competent Registro Civil office (check contacts at https://sede.mjusticia.gob.es). Keep the receipt of submission.
  5. 5.In 1–4 semanas, check that the marginal note was made by requesting a certificado literal de matrimonio updated copy (online or at your Registro Civil via https://sede.mjusticia.gob.es).
  • Authorized copy of the public deed of capitulations granted before a notary (if foreign: apostilla de La Haya and sworn translation)
  • DNI/NIE or passport of both spouses (or future spouses)
  • Certificado literal de matrimonio if you’re already married (so the note can be added in the margin)
  • Registration details of the marriage: Registro Civil, tomo, página and municipality (or a copy of the old Libro de Familia if you have it)
  • Número de expediente matrimonial if the capitulations are prenuptial and you already have a file
  • Notarial power of attorney if someone files on your behalf (Poder notarial)
