Emancipation in the Registro Civil: how to obtain it and register it

If you're 16 or 17 and want expanded legal capacity, here’s how to get emancipation and register it in the Registro Civil. This applies if it's granted by your parents/tutor, by a notary, by a court order or by marriage.

- 1.Check you have turned 16 and get your certificación literal de nacimiento from the sede de Justicia (look for 'Certificado de nacimiento' at sede.mjusticia.gob.es) or from your Registro Civil.
- 2.Fast route at the Registro Civil: go with your parents/tutor to the Registro Civil of your domicilio or where you are registered, and sign the consent to emancipation there before the Encargado.
- 3.Notary route: book an appointment with a notary, sign the escritura de emancipación and get the copia autorizada to register at the Registro Civil (some notaries send it electronically, but don’t rely on that — submit your copy too).
- 4.Judicial route: file an expediente de jurisdicción voluntaria at the Juzgado de Primera Instancia for your domicilio; when you have the auto firme, request its inscription in the Registro Civil providing the testimonio.
- 5.Request inscription of the emancipation in the Registro Civil where your birth is registered or in the Registro Civil of your domicilio (if that office already uses DICIREG you can submit electronically with Cl@ve via the sede de Justicia; if not, do it in person at the counter).
- 6.When they confirm the asiento has been made, download/request a certificación literal de emancipación from the sede de Justicia or collect it at the Registro Civil to use in other procedures.
