Powers for court cases (apud acta or notaría)

Procedural deadlines are final. We make sure you arrive on time with evidence.

Use this to authorise your lawyer and procurador to represent you in a trial. You can grant it for free “apud acta” via the Sede Judicial Electrónica or at the court office; at a notary it costs money.

Guía completa

What you need to have to hand
  1. Cl@ve Permanente + Cl@ve Firma or certificado digital/DNIe (with PIN and a working reader). Cl@ve PIN can make signature problems sometimes.
  2. Datos del abogado y procurador: NIF, full name, number of colegiado and colegio. Ask them by WhatsApp and copy/paste.
  3. If the power is especial, the órgano judicial y número de procedimiento.
  4. If you sign for a company, your powers (escritura and current appointment) and the company NIF.
Documentation
  • DNI/NIE/pasaporte (or the ID method to sign online).
  • Professional details of lawyer and procurador.
  • Case references (juzgado and procedure number) if it’s a special power.
  • Mobile and email to receive the justificante and notices.
  • For legal persons, title of representation (escritura, appointment, current certificate from the Registro Mercantil).
Step by step
  1. Entra en https://sedejudicial.justicia.es e identifícate.
  2. Busca “Apoderamiento apud acta”.
  3. Añade a tu abogado y, si procede, a tu procurador: NIF, nombre, número y colegio correcto. Sin errores.
  4. Marca las facultades que quieres incluir (allanarse, desistir, transigir, cobrar cantidades, renunciar a recursos…). Si no las marcas, no existen.
Time-savers
  • Use Cl@ve Permanente + Cl@ve Firma or certificado; fewer signature issues than with PIN.
  • Ask your procurador for their exact NIF and nº de colegiado. One wrong digit and you’ll repeat the process.
  • If unsure, grant a poder general and tick facultades especiales. It covers future cases.
  • Save the PDF and the CSV in the cloud. Recovering them later is a pain.
  • If you’re abroad, do it online. Turning up at the court without a cita is a waste of time.
Common mistakes that will mess up the procedure
  • Confusing this with the apoderamiento of sede.administracion.gob.es (that’s for administrative procedures, not trials).
  • Not marking facultades especiales and later your procurador can’t allanarse or transigir.
  • Entering the wrong colegio or colegiado number. The court will reject it and you lose days.
  • Failing to file the power within the plazo the court gives you (suele ser 10 días). They can treat you as not personado.
  • Assuming it expires by itself. The power remains active until you revoke it. If you change procurador, revoke the old one.
