Rectification of the sex mention in the Registro Civil

What you need to have to hand

1. Cl@ve, certificado digital o DNIe if your Registro Civil allows it online.
2. DNI/NIE or passport in force.
3. Empadronamiento reciente (less than 3 months) to prove that RC is the competent one.
4. New name (if you want to change it) thought out with 1–2 alternatives.
5. If you’re a minor: documentation of your representatives and, if you are 12–14, auto judicial of authorisation.

Documentation

• Identificación: DNI/NIE or passport.
• Certificado de empadronamiento for the competent Registro Civil.
• Declaración de voluntad de rectificación (form from the RC or on the Sede, depending on digitalisation).
• Cambio de nombre: proposed name compliant with rules (optional, but recommended to do at the same time).
• Minors 14–16: DNI of parents/guardians and Libro de Familia or tutela resolution.
• Minors 12–14: auto judicial of prior authorisation.
• Certificación literal de nacimiento: only if they ask due to particulars of the asiento.

Step by step

1. Check if your RC already processes it online: go to https://sede.mjusticia.gob.es with Cl@ve/certificado. If the trámite doesn’t appear for your province, it’ll be presencial.
2. Initial application: at the RC of your domicilio, sign the declaración de voluntad. Use that moment to request cambio de nombre if you want it.
3. Legal 3‑month wait: they will cite or notify you for the ratification. Note the date (day + time) and don’t miss it.
4. Ratification: after 3 months (minimum), return and ratify. If your RC allows, you can ratify online with Cl@ve.
5. Resolution and registration: the RC registers the change and notifies you. Request a certificación literal de nacimiento as soon as they register it (online or at the counter).
6. Update documents: book DNI/pasaporte (https://www.citapreviadnie.es), Seguridad Social (https://importass.seg-social.es), AEAT (https://sede.agenciatributaria.gob.es), DGT (https://sede.dgt.gob.es), etc.

Tricks that save time

• Fresh empadronamiento: take it recent or they’ll send you back.
• Decide the name in advance: avoid back-and-forth over unacceptable names (avoid very rare or legally problematic choices).
• Ask for the electronic literal once they register: saves queues and lets you start updating everything.
• Set a calendar alarm for the ratification: if you miss it they archive and you restart.
• If your RC isn’t digitalised, bring a written application prepared with your data and a short declaration that you don’t identify with the sex on record.

Common mistakes that can derail your process

1. Not ratifying at 3 months: expediente dead. You’ll need to start again.
2. Going to the wrong RC: without empadronamiento for the municipality they’ll refuse and you lose the morning.
3. Trusting the name will pass: if the name doesn’t meet rules, they’ll reject it and delay everything.
4. Thinking it’s instant: there’s a legal wait. No one will skip it.
5. Accepting requirements that don’t exist: medical reports, witnesses or treatments are not required. If they ask, complain citing Ley 4/2023.
6. Not asking for the literal after registration: without it, updating DNI, SS or DGT becomes a mess.
