- 1.Find and book an appointment with a notario in your city (portal del Notariado: https://www.notariado.org/portal/ciudadanos). Tell them you’re making a testamento abierto and ask for a price estimate.
- 2.Prepare a simple outline of what you want (who inherits, specific legacies, substitutions, powers). Send it to the notario by email if they offer a draft service so they can prepare a borrador.
- 3.Go to the notaría with your DNI/NIE and the heirs’ details. The notario will read the escritura, explain legítimas and legal limits, and you’ll adjust the text together.
- 4.Sign the will in front of the notario. They’ll give you a copia simple and, if you request it, a copia autorizada (may take 1–3 days). Pay the arancel notarial there and then.
- 5.The notario reports the granting ex officio to the Registro General de Actos de Última Voluntad. You don’t have to register anything yourself.
- 6.Optional (for your heirs when you die): they request the Certificado de Últimas Voluntades on the Ministerio site with Cl@ve/certificado: https://sede.mjusticia.gob.es/es/tramites/certificado-ultimas-voluntades (you pay the tasa 790-006).
- 7.If you’re missing a Registro Civil certificate (marriage, birth), you can request it online at https://sede.mjusticia.gob.es/es/tramites/certificado-matrimonio or the relevant trámite.
