Tutelas y curatelas: judicial appointment and registration in the Registro Civil

What you need to have handy

1. Resolución judicial firme that appoints you as tutor or curador (auto or sentencia with stamp and signature, preferably a testimonio). Without finality, the RC won't register.
2. DNI/NIE of the tutelado/curatelado and of the tutor/curador.
3. Certificado de empadronamiento of the tutelado to fix the competent RC.
4. Certificación literal de nacimiento of the tutelado if your RC is not connected to DICIREG.
5. Libro de Familia if it’s a tutela of a minor.
6. If they exist, medidas voluntarias notariales (poder preventivo, autocuratela) and autorizaciones judiciales to administer assets.

Documentation

• Testimonio de la resolución judicial firme with detail of functions (representation, administration, acts that require authorisation, etc.).
• Identification of everyone (tutelado/curatelado and tutor/curador).
• Recent empadronamiento (3 months or less usually works) of the tutelado.
• Literal de nacimiento of the tutelado if the RC asks or cannot verify it in its system.
• Libro de Familia when the tutelado is a minor.
• Medidas voluntarias notariales if they affect the support (not always necessary, but they help avoid bank doubts).

Step by step

1. Got a resolution? If not, go to the Juzgado de Primera Instancia of the interested person’s domicile. It’s the expediente de provisión de apoyos. In practice, you need abogado and procurador; if Fiscalía promotes, they will summon you. This can take months.
2. With the final resolution, log in to https://sede.mjusticia.gob.es with Cl@ve. Go to Registro Civil and find the inscripción de tutelas/curatelas (representaciones legales).
3. Fill the form: details of the tutelado and the tutor/curador, and select the RC competente (usually the tutelado’s domicilio; some register at the RC of birth).
4. Attach PDFs: testimonio judicial firme, DNIs/NIEs, empadronamiento and, if requested, the literal de nacimiento. No blurry photos: scan cleanly.
5. Sign and present. Save the justificante de registro. If the RC is in DICIREG you’ll get notices via the sede or email. If something’s missing, you’ll receive a requerimiento de subsanación.
6. RC not listed on the sede? Submit via the Registro Electrónico Común: https://rec.redsara.es, directing the application to the Registro Civil that corresponds, or go in person. Attach the same documents.
7. Request the certificación literal of the registration once they confirm it’s done. You’ll need it for banks, AEAT, DGT, Seguridad Social and anyone else asking for proof of representation.

Tricks that save time

• Check the resolution: make sure it clearly says what you can do (is representation allowed and which acts). If not, the bank will stall you.
• DICIREG isn’t everywhere: if your RC isn’t connected, use the REC from the start to avoid bouncing.
• Format and quality: upload clear PDFs. If it’s an electronic testimonio, even better.
• Browsers: the sede de Justicia works better with Chrome/Edge. Avoid old Safari; it can fail when signing.
• Inventory: if the resolution requires an inventario de bienes, have it ready. The court may require it and third parties will ask for it later.

Common mistakes to avoid

1. Trying to register with a non-final resolution. They will reject it.
2. Not attaching the literal de nacimiento when the RC isn’t in DICIREG. Result: a requerimiento and lost weeks.
3. Vague curator functions. Then the bank won’t let you operate. If the resolution is ambiguous, ask the court for clarification.
4. Thinking there’s a fee and not presenting: it’s free. There’s no Modelo 790 or similar for this.
5. Not asking for the certificación literal after registration. Without the paper (or certified PDF), administrations and banks won’t accept you.
