Step by step
- Emergency = call: if there’s risk of death or injury, call 112, 091 (Policía) or 062 (Guardia Civil). Say “maltrato animal, art. 340 bis”. Ask for a patrol.
- Formal in-person denuncia: go without appointment to a comisaría or cuartel. Ask to file denuncia por maltrato/abandono animal (art. 340 bis CP). Tell the facts in detail: who, how, where and when.
- Hand in evidence: show your phone and, if possible, bring a USB with copies. Make sure the denuncia records what you provided. Keep originals and back them up.
- Ask for the atestado number and a copy of the denuncia. Ask whether SEPRONA will handle it (if rural) and if medidas cautelares (animal removal) will be requested.
- Online alert if you can’t go: use the Policía maltrato animal form: https://www.policia.es/_es/colabora_702.php. Use it to give location, facts and attach evidence. They may call you or send you to a comisaría to sign.
- Follow up: if the court or unit contacts you, provide what’s missing. If new proof shows up, return with the atestado number to add it.
Time-savers
- Record horizontally and keep the camera steady. It’s clearer.
- Ask 112 if you’re unsure who to call: they’ll forward you to 091/062.
- Back up videos before going: cloud or a second device.
- Note down matrícula and exact times; you’ll forget them later.
- Ask that everything is recorded in the denuncia: risks, repetition, minors present, etc.
Common mistakes to avoid
- Thinking ‘Colabora’ is a denuncia: it isn’t. It’s an alert. To get an atestado with a copy, you must go sign it.
- Editing evidence: filters, cropping and WhatsApp compresses and strips metadata. Bring originals.
- Entering private property to record: you risk a crime. Record from public areas.
- Taking the animal without permission: it may be considered hurto. Call and make the removal official.
- Not asking for a copy or atestado number: then you can’t follow up.
- Posting on social media before reporting: it can harm the case and warn the responsible person.

- 2.Go without an appointment to a Policía Nacional Comisaría or a Guardia Civil Cuartel. Say you want to file a denuncia por maltrato/abandono de animales (art. 340 bis) and explain what you saw with dates, place and how you saw it.
- 3.Hand over the evidence: show the phone and, if possible, bring a copy on USB. Let them copy it and keep the originals. Don’t delete or edit anything.
- 4.Ask for the atestado/diligencias number and a copy of your denuncia. Ask about medidas cautelares (removal of the animal) and whether SEPRONA will take it on (rural areas).
- 5.If you can’t go in person and it’s not urgent, send an alert with details and evidence via the Policía website: https://www.policia.es/_es/colabora_702.php. Use it to flag the case; for a formal denuncia they’ll later call you or you’ll need to go sign.
- 6.Follow up: if the court or the unit calls you, provide anything missing and update information. If new evidence appears, return to the comisaría/cuartel with the atestado number to add it.
- DNI/NIE/pasaporte del denunciante (if you’re going to file a formal denuncia; anonymous alerts only work via ‘Colabora’)
- Exact address of the incident (street, number, municipality) and approximate date/time
- Original, unedited photos and videos (better if metadata or location is enabled)
- Witness details and contact phones (if any)
- Vehicle matrícula, make and colour (if applicable)
- Veterinary reports or reports, microchip number or animal details if you know them
- Screenshots of adverts, chats or posts where abuse/abandonment is offered or admitted
- Any prior documents of reports to Ayuntamiento/SEPRONA or previous incidents
‘Colabora’ no sustituye a la denuncia formal
The colaboración form is for alerting and supplying info, even anonymously. If you want an atestado with a copy and diligencias number, you must identify yourself and sign at a comisaría or cuartel.
No te lleves al animal por tu cuenta
As painful as it is, taking the animal without authorisation can get you into trouble (hurto). Call 091/062 and ask for a precautionary removal. Only act yourself if there’s a vital risk and no response, and log everything.
Grabar sí, pero sin invadir domicilios
You can record in public spaces. Don’t enter private properties or break in to get evidence: you risk allanamiento. Avoid manipulating files; keep originals.
Denuncias falsas están penadas
Making up facts or pointing the finger without basis can lead to a 456 CP. If in doubt, provide what you saw and let them investigate.
¿Puedo denunciar de forma anónima?
To start diligencias with a copy you need to identify yourself at a comisaría/cuartel. If you only want to alert, use the Policía ‘Colabora’ form or call 062/091, but that may result only in an intervention/notice without a copy for you.
¿Qué hago si el animal está en una finca privada?
Don’t go in. Call 062 (Guardia Civil) or 091 and ask for a patrol. From outside, record what you can without invading property and give the exact location. SEPRONA handles rural areas.
¿Puedo grabar o hacer fotos sin problemas?
On the street yes. Don’t publish personal data before filing the denuncia. Always keep originals unedited; if possible, back them up to the cloud in case you lose your phone.
¿Hace falta abogado para poner la denuncia?
No. You don’t need a lawyer to file the denuncia. If the court calls you as the complainant, you can go alone; they’ll tell you if anything else is needed.
¿Me puedo llevar al animal al veterinario directamente?
Only if authorised by the patrol or the competent authority. If you do it on your own it can be a legal problem. Call and make the removal and transfer official.

In cities, call 091 (Policía Nacional). In rural areas, call 062 (Guardia Civil/SEPRONA). If unsure, call 112 and they’ll route you.

If there’s risk, they usually send a patrol immediately. Judicial/administrative investigations and measures take longer. Ask for the atestado number and follow up.
