Appeal or alegaciones to a traffic fine (DGT)
Use this to file alegaciones or an appeal against a DGT fine if you disagree, or to identify the driver if it wasn’t you. Handy if you want to fight the sanction, avoid a “failure to identify” penalty or correct data.

What you need to have to hand

Documentation
- Notificación de la multa (PDF/photo) so you don’t mix up expediente numbers.
- Escrito de alegaciones (if you’re within the 20 días naturales) or recurso de reposición (if there’s already a resolución). Sign and date it.
- Evidence that supports your story: misposted sign, valid ticket, breakdown, vehicle sold, theft (police denuncia), etc.
- Autorización/apoderamiento if you act for someone or for a company.
- Driver data if asked to identify: name, NIF/NIE, address, driving licence number and country.
Step by step
- Go to the sede: sede.dgt.gob.es > Multas > Presentación de alegación o recurso and log in with Cl@ve/certificado.
- Enter the expediente and check the fine. Decide: alegaciones (20 días naturales) or reposición (1 mes).
- Fill the form and attach your PDF with arguments and your request (archivo, correction, nullity…). Add evidence.
- If you weren’t the driver, use the identificar option: complete every dato and attach support.
- Check and send. Download the justificante (CSV) and keep everything.
- Watch DEV/post for requests to subsanar or the resolution. If reposición isn’t answered in 1 mes, it’s silencio desestimatorio.
- If the sede fails, use the Registro Electrónico General (rec.redsara.es) addressed to DGT, attaching your escrito, the notification and evidence.
Time-saving tips
- Write plain and concise: facts, legal basis and your request. Less waffle, more evidence.
- Attach lightweight PDFs. The sede has size limits; compress files first.
- If you’re unsure between the 50% payment or fighting it, decide before you act. Mixing is fatal.
- Activate and check DEV: you’ll get notified earlier and won’t miss deadlines.
- Always keep the CSV: it’s your proof if something goes missing.
Typical mistakes that can ruin your case
- Mixing up deadlines: the 20 días naturales are calendar days, not business days.
- Failing to identify the driver in time: you’ll get another, bigger sanction.
- Sending empty alegaciones: no evidence = likely dismissal.
- Paying with the discount and then appealing: doesn’t work, you renounced the right.
- Wrong data (plate/expediente): your appeal can end up in limbo.
- Assuming an appeal suspends collection: only if you ask for suspension and it’s granted (usually with guarantees).
- 1.Go to https://sede.dgt.gob.es/es/multas/presentacion-de-alegacion-o-recurso-a-una-multa/ and log in with Cl@ve, certificado digital or DNIe.
- 2.Enter the número de expediente and check it’s your fine. If you need to identify another driver, tick that option and have their datos ready.
- 3.Choose what you’re filing: alegaciones (within 20 días naturales from the denuncia/notificación) or recurso de reposición (1 mes from the resolución sancionadora).
- 4.Fill in the form and attach your escrito in PDF and the evidence (photos, tiques, reports…). Say clearly why and what you want (filed, reduced, data corrected…).
- 5.If you identify the driver, give their full datos and attach, if you have it, a copy of their DNI and licence. Double-check details — mistakes here cost you.
- 6.Submit and save the justificante with CSV. Watch your buzón (DEV or post) in case they ask for补s or notify the resolution.
- 7.If the sede is acting up, use the Registro Electrónico General (recipient: Dirección General de Tráfico) at https://rec.redsara.es/ attaching your escrito, the notification and the expediente.
- DNI/NIE and Cl@ve, certificado digital or DNIe to ID yourself on the sede
- Número de expediente de la multa and fecha de notificación (they’re on the letter/SMS/DEV)
- Copy of the notificación de la multa (PDF or a readable photo)
- Escrito de alegaciones or recurso de reposición signed in PDF (clear, with facts, law and request)
- Evidence: photos of the place/signs, parking tique, workshop/tow reports, ITV/insurance receipt, compraventa contract, etc.
- If you weren’t the driver: full datos del conductor (name, NIF/NIE, address, driving licence number) and, if possible, a copy of their DNI
- If acting for someone or a company: written autorización or power of attorney registered with the DGT and the represented person’s DNI
- Active domicilio or DEV for notifications (check it’s correct)
Actual deadlines that really matter
Alegaciones and driver identification: 20 días naturales. Recurso de reposición: 1 mes. Note: naturales are not hábiles. If they notify you via DEV/Tablón Edictal (TEU), the countdown starts from that publication.
50% discount and appeals don’t mix
If you pay with the 50% reduction you waive the right to appeal. If you file an appeal, you lose the reduction. Decide before you click pay.
Not identifying the driver is very expensive
If you don’t identify the driver when required, you get another sanction (it can double or triple the amount depending on severity). You have 20 días naturales to identify.
Silence on reposición
If they don’t answer a recurso de reposición within 1 mes it’s deemed rejected by silence. After that, only contencioso-administrativo remains if you want to push on.
Appealing doesn’t stop collection automatically
Filing an appeal does not suspend enforcement by default if the case is already in vía de apremio. If you need suspension, request it explicitly and be ready to provide guarantees.
Legal entities must use electronic channels
Companies and some entities are obliged to use electronic means and DEV. No paper. If you signed up to DEV as a private person, you’ll be notified there too.
Do I lose the 50% if I file alegaciones or an appeal?
Yes. Paying with the reduction means renouncing to allege or appeal. If you file alegaciones or recurso, you can’t pay with the 50% afterwards.
How long until they reply?
Alegaciones usually move in a few weeks. Recurso de reposición has 1 mes by law to be resolved, but it can stretch. If a month passes with no answer on reposición, it’s silencio desestimatorio.
Can I submit without a certificado digital?
Online you need Cl@ve, certificado or DNIe. Alternative: Registro Electrónico General (rec.redsara.es) — you still use Cl@ve. In-person at a Jefatura is possible, but you’ll usually need cita previa and it’s slower.
What evidence actually helps?
Clear photos of the place/sign, zona azul ticket, workshop/tow report, ITV/insurance receipt, compraventa contract if you weren’t the owner, GPS/telepeaje timestamps that match. Anything that proves concrete facts.
What if it’s already in embargo or ejecución?
The appeal doesn’t stop it automatically. You’d have to ask for suspensión and provide guarantees. If you don’t, apremio continues with surcharges.
I wasn’t the driver, how do I say that?
Identify the driver within 20 días naturales from the requerimiento. Do it via the DGT multas sede providing full datos and, if possible, copy of their DNI and licence.
