Claiming the cessation of activity benefit if you're self-employed

SEPE rejects forms with a single mistake. We review your draft before submission.

If you had to stop your business and you're self-employed, this is where you apply for the 'self-employed unemployment' benefit. I explain how to unregister correctly and claim the benefit through your Mutua so you don't miss deadlines or money.

Guía completa

What you need to have to hand
  1. Cl@ve or certificado digital (for Importass and AEAT).
  2. Deregistration receipts: RETA (Importass) and 036/037 at Hacienda.
  3. Your Mutua (FREMAP, Asepeyo, MC Mutual, Ibermutua…). Check which one in your Importass area.
  4. Proofs of cessation: losses, TRADE rescission, force majeure, etc.
  5. Recent tax forms: 303/390 (IVA) and 130/131 (IRPF).
  6. Bank account in your name (IBAN).
Documentation
  1. DNI/NIE and, if applicable, TIE.
  2. Baja en RETA (PDF from Importass) and baja censal 036/037 (AEAT).
  3. Reason for cessation:
    • Losses: books/journal, 130/131, 303/390, bank statements.
    • TRADE: contract and communication of rescission.
    • Force majeure: reports/minutes.
    • Administrative/judicial resolution: copy.
  4. Certificate of being up to date with the Seguridad Social or invitación al pago.
  5. Libro de familia (if you have family responsibilities) and IBAN.
Step by step
  1. Deregister in RETA: log in with Cl@ve to Importass and do the baja en trabajo autónomo (https://importass.seg-social.es/tramites/baja-en-trabajo-autonomo). Download the receipt.
  2. Deregister in Hacienda: file the Modelo 036/037 of baja censal online (https://sede.agenciatributaria.gob.es/Sede/procedimientoini/GC29.shtml). Keep the PDF.
  3. Locate your Mutua in Importass and collect the proofs of the reason (losses, TRADE, etc.). If unsure, check the list of Mutuas: https://www.seg-social.es/wps/portal/wss/internet/Empresas/Mutuas.
  4. Apply for the cessation benefit at your Mutua's electronic office. Fill their form, attach the deregistrations, tax forms and proofs. Sign and submit.
  5. Register as a jobseeker (if requested): book an appointment at https://sede.sepe.gob.es/citaprevia and register with your regional service. Upload the receipt to the Mutua if they ask for it.
  6. Answer requests: if they ask for more papers, upload them within 10 days. Don't leave it until the last moment.
  7. Check the resolution and the payment. If they deny it and you disagree, alega within the deadline.
Tips that save you time
  1. Do Importass and AEAT on the same day. Without both deregistrations, the Mutua won't look at your claim.
  2. Order your PDFs: name files like "01_BajaRETA", "02_036", "03_IVA", etc. Avoid rejections due to unreadable files.
  3. Chrome and Cl@ve: many Mutua portals work better in Chrome; have Cl@ve PIN and your certificate ready.
  4. Work out bases and periods from Importass: they may ask for the contribution bases for the 12 months; download them before they request them.
  5. Invitation to pay: if they send it, pay within 48-72h and upload the receipt. It can save you a needless denial.
Common mistakes that can set you back
  1. Applying late (more than 30 days): you lose days or they reject you.
  2. Not proving the reason: saying "business is bad" without losses evidenced or without rescission if you're TRADE = denial.
  3. Forgetting the baja censal: RETA alone isn't enough; 036/037 is essential.
  4. Blurry or unsigned documents: a crappy scanned PDF, missing signatures or pages; they'll send it back.
  5. Continuing to invoice after applying: incompatible; if they catch you, repayment and possible sanctions.
  1. 1.Go into Importass (https://importass.seg-social.es) with Cl@ve and process the Baja en trabajo autónomo: https://importass.seg-social.es/tramites/baja-en-trabajo-autonomo
  2. 2.Submit the baja censal to Hacienda with Modelo 036/037 (Cl@ve or certificate) on the AEAT site: https://sede.agenciatributaria.gob.es/Sede/procedimientoini/GC29.shtml
  3. 3.Check which Mutua you have in your Importass personal area and gather proofs of the reason for cessation (losses, TRADE, force majeure…) together with your IVA/IRPF forms
  4. 4.File the solicitud de prestación por cese de actividad at your Mutua's electronic office (or ISM if you're maritime). If you don't remember your Mutua, here's the official list: https://www.seg-social.es/wps/portal/wss/internet/Empresas/Mutuas
  5. 5.If your Mutua requires registration as a jobseeker, book an appointment and register at your regional service via SEPE: https://sede.sepe.gob.es/citaprevia
  6. 6.Respond to your Mutua's requests and provide additional documents within the deadline (they usually give 10 days)
  7. 7.Check the resolution and the monthly payment; if they deny it, consider filing alegaciones within the deadline
  • DNI/NIE and, if you're foreign, NIE and TIE valid
  • Modelo 036 or 037 of census deregistration submitted to Hacienda (AEAT)
  • Deregistration from RETA (Importass receipt after doing the self-employment deregistration)
  • Proofs of the reason for cessation (losses: books/IRPF/IVA; closure due to force majeure: reports; TRADE: contract and termination; administrative or judicial resolution, etc.)
  • Tax proofs: latest Modelo 303/390 (IVA) and 130/131 (IRPF) filed
  • Certificate of being up to date with the Seguridad Social or an invitation to pay
  • Libro de familia if you have family responsibilities
  • IBAN of your bank account in your name
