What to have ready

Step by step
- Collect reports and make sure they’re up to date. If tests are missing, ask your specialist to put them in writing.
- Apply online at https://tramites.seg-social.es/acceso/solicitud-prestaciones-inss with Cl@ve/certificate. Choose Incapacidad Permanente, fill in details, attach clear PDFs and sign.
- Can’t do it online? Book an INSS appointment: https://sede.seg-social.gob.es/wps/portal/sede/sede/Inicio/Servicios/Cita+Previa+para+Pensiones+y+Otras+Prestaciones+del+INSS and hand in the paper application with attachments.
- The EVI (medical tribunal) will call you. Be on time and bring everything. If you get new reports after applying, bring printed copies.
- Track the case on Tu Seguridad Social: https://sede.seg-social.gob.es/wps/portal/tuss. Turn on notifications; emails can go to spam.
- You get the resolution. If denied or the degree is wrong, file a reclamación previa within 30 días via the sede (Presentación de escritos) or at registro. If it remains unfavourable, file a demanda in 30 días at the Juzgado de lo Social.
Time-saving tips
- The Seguridad Social portal works better in Chrome/Edge than on mobile. Avoid Safari.
- One PDF per bundle (clinical reports, tests, mutua). Fewer files, less hassle.
- Add a short written note explaining your real functional limitations at the job you used to do. It helps the EVI.
- If you have children and meet the conditions, ask for the complemento de brecha de género in the same application.
- Update Modelo 145 when your pension is recognised so you don’t get unpleasant IRPF surprises.
Common mistakes that can derail the process
- Not attending the EVI appointment. They can archive your file and you start again.
- Uploading outdated or unreadable reports. They’ll ask you to fix it and you’ll lose weeks.
- Thinking IP always bars you from all work. It depends on the degree; check before accepting or rejecting gigs.
- Missing the deadlines: 30 días for reclamación previa and then 30 for a demanda. Miss them and it’s over.
- Expecting this to be done in 15 days. Legally they have up to 135 días and it often takes longer.

- 2.Log in with Cl@ve or certificate at https://tramites.seg-social.es/acceso/solicitud-prestaciones-inss and choose Incapacidad Permanente. Fill the form, attach reports and add your IBAN.
- 3.If you can’t do it online, book an INSS appointment at https://sede.seg-social.gob.es/wps/portal/sede/sede/Inicio/Servicios/Cita+Previa+para+Pensiones+y+Otras+Prestaciones+del+INSS and hand in the paper application with the documents.
- 4.Watch for the EVI (medical tribunal) appointment. Go on the date they give you with all reports and tests; if you get new reports, take them.
- 5.Check status and notifications on Tu Seguridad Social: https://sede.seg-social.gob.es/wps/portal/tuss (works better with Chrome) or by email if you selected it.
- 6.You receive a resolution. If it’s denied or you disagree with the degree, file a reclamación previa within 30 days via https://sede.seg-social.gob.es/wps/portal/sede/sede/Inicio/Servicios/Presentacion+de+otros+escritos%2C+solicitudes+y+comunicaciones or at registro, and then, if needed, bring a claim to the social court.

Deadlines and silence
The INSS has up to 135 días to resolve. If they don’t reply, silence is usually negative. If they deny it or you disagree, you have 30 días for the reclamación previa and then 30 días for a labour claim.
Compatibility and reviews
IP Total lets you work in a different profession; Absoluta/Gran Invalidez is generally incompatible with working. The INSS can review your situation for improvement/worsening, especially before 2 years.
Appointments and tech
INSS appointments get taken early in the morning. The Tu Seguridad Social portal usually runs better in Chrome/Edge than on mobile. If you upload blurry reports, they’ll ask you to re-submit and you’ll delay the whole process.

Can I work if they recognise a Permanent Disability?
It depends on the degree. With IP Total you can work in a different profession. With Absoluta or Gran Invalidez, generally not; only very limited, compatible work, and you must inform the INSS.
How much contribution history do I need for it to be granted?
If it comes from a work accident or occupational disease, no contribution period is required. If it’s due to common illness, minimum contributions vary by age and history; the INSS checks this automatically. If in doubt, attach your vida laboral.
From when do I get paid and will I receive arrears?
You’re paid from the effective date set in the resolution. If you come from an IT and are moved to IP, arrears are usually paid from that effective date. Update Modelo 145 so you don’t get over-withheld on IRPF.
Will they call me to the medical tribunal?
Usually yes, the EVI calls you. If you miss it without justification, they can file the case away. Bring recent and clear reports; without up-to-date tests they’re more likely to reject it.
I’m self-employed, does anything change?
Provide your contribution records and, if you’ve got professional contingencies with your mutua, its reports. IP may be compatible with very limited activities, but be careful invoicing without informing the INSS.
What if they deny it?
File a reclamación previa to the INSS within 30 días. If that’s dismissed or they don’t answer, bring a demanda to the Juzgado de lo Social within another 30 días. Don’t miss these strict deadlines.
