Pensión de orfandad del INSS: how to apply and get paid

What you need to have to hand
- Cl@ve, certificado digital or DNIe to access Tu Seguridad Social.
- Deceased's details: DNI/NIE and date of death.
- Beneficiary details: DNI/NIE of the minor and of the legal representative.
- Bank account (IBAN) in the name of the minor or the tutor.
- Scanner/phone to make legible PDFs (under 10 MB per file if possible).

- Certificado literal de defunción of the deceased parent.
- Libro de familia or certificados literales de nacimiento proving parenthood.
- DNI/NIE of the beneficiary and of the person signing the application.
- Resolución de tutela/guarda o acogimiento, if applicable.
- Sentencia de separación/divorcio and convenio regulador, if applicable.
- Certificado de empadronamiento/convivencia, if requested for absolute orphanhood or residence doubts.
- Certificado de discapacidad of the orphan, if any.
- IBAN and, if asked, proof of account ownership.
If the death happened abroad, prepare traducción jurada and Apostilla if required.
Step by step
- Log in to Tu Seguridad Social: https://sede.seg-social.gob.es/wps/portal/tuss/inicio with Cl@ve/certificado.
- Go to Solicitar prestaciones and choose Orfandad. Fill in the deceased and beneficiary details. Add the legal representative if the minor can't sign.
- Attach PDFs: defunción, filiación, tutela/guarda, judicial resolutions and whatever your case needs.
- Enter IBAN, accept declarations and sign with Cl@ve Firma. Download the receipt of registration.
- If you don't have digital means, book a cita at a CAISS: https://sede.seg-social.gob.es/wps/portal/sede/cita-previa and bring the Solicitud de prestaciones de supervivencia on paper plus the documents.
- If you receive an invitación al pago from TGSS for the deceased (common with autónomos), pay it at Import@ss: https://importass.seg-social.es and then upload the proof from Tu Seguridad Social.
- Check notifications and the status of the file in Tu Seguridad Social. When the resolution is issued you'll see the effective date and the first payment.
Time-saving tips
- Get the death certificate quickly from the Registro Civil or online; you can't move forward without it.
- Make one PDF per document and name them clearly (Defuncion.pdf, LibroFamilia.pdf…). Avoid blurry photos.
- If the site misbehaves, use Chrome and allow pop‑ups to download the receipt.
- If the minor has no account, open an account in their name with the tutor as authorised. They'll ask for it sooner or later.
- If the deceased was autónomo, check Import@ss for debts to anticipate an invitación al pago.
Common mistakes to avoid
- Applying late: more than 3 months after the death and you lose arrears (they only backdate 3 months).
- Not attaching tutela/guarda when there's no parent with patria potestad. INSS will stop the file.
- IBAN without clear ownership of the beneficiary/representative: you'll get a requerimiento.
- Foreign documents without apostilla/translation: inadmissible or they will request it and you'll lose weeks.
- Not watching notifications: they ask for something, you don't answer and the file gets archived.
- Working without telling them and exceeding income limits: suspension and possible repayment demands.

- 2.Go to Solicitar prestaciones and choose Orfandad; fill in the deceased's details (DNI, date of death) and the beneficiary's details; add the legal representative if the minor can't sign.
- 3.Attach PDFs: defunción, filiación (Libro de familia or certificados), tutela/guarda if needed, and any judicial orders.
- 4.Enter the IBAN, confirm account ownership and sign the application with Cl@ve Firma; download the registration receipt (keep it).
- 5.If you don't have Cl@ve/certificado, book an appointment at a CAISS here: https://sede.seg-social.gob.es/wps/portal/sede/cita-previa and submit the Solicitud de prestaciones de supervivencia on paper with the documentation.
- 6.If the deceased was self-employed and TGSS sends an “invitación al pago” for pending contributions, pay it at Import@ss: https://importass.seg-social.es or at your bank and then upload the receipt from Tu Seguridad Social (Aportar documentación a tu expediente).
- 7.Check the case status and notifications in Tu Seguridad Social; when it's approved you'll see the resolution and the first payment date.
- DNI/NIE of the minor beneficiary and of the parent/guardian who signs the application
- Libro de familia or certificados literales de nacimiento proving parenthood
- Certificado literal de defunción del causante (from the Registro Civil)
- IBAN where the pension will be paid (in the name of the minor or the legal representative, with verifiable ownership)
- Resolución de tutela/guarda or auto de acogimiento, if there is no parent with patria potestad
- Sentencia de separación/divorcio and convenio regulador, if applicable
- Certificado de empadronamiento/convivencia if they ask for it in cases of absolute orphanhood or residence doubts
- Certificado de discapacidad of the orphan (≥33%) if relevant for age/requirements
Key deadline after the death
If you apply within the first 3 months after the death, payments start from the day after the death. If you miss that window, they can only pay retroactively up to 3 months.
Age and studies
Normally the pension is paid until 21. It can extend to 25 if you meet conditions (studies/limited income). If you turn 25 during a school year, it's usually kept until the end of the course (watch the dates).
Debts of the deceased (self-employed)
If there were unpaid contributions, TGSS may send an “invitación al pago”. Until that's resolved, the decision can stay pending. That delays the payment.
Formats and signatures
Online they'll ask for PDFs and a signature with Cl@ve Firma. Have your phone ready. If it fails, try Chrome and disable pop‑up blockers to download the receipt.

Orfandad es gratuito en INSS / TGSS y se puede presentar por cuenta propia. Up to what age can I receive the orphanhood pension?
Normally up to 21. It can be extended to 25 if you meet certain conditions (studies and/or income limits). If you have a recognised disability there are other rules and it may continue beyond those ages.
Can I work and still get the orphanhood pension?
Yes, but there are limits. If your income exceeds the allowed threshold they can suspend the pension. If you start working, inform the INSS and ask about your specific case so you don't get a nasty surprise.
When do payments start and what about arrears?
If you apply within the first 3 months, payments count from the day after the death. If you apply later, they can only backdate payments up to 3 months.
If the deceased owed contributions as a self-employed person, do I lose the pension?
Not necessarily. TGSS usually sends an invitación al pago to clear contributions. If you pay or regularise it, INSS can recognise the pension. If it's ignored, you may lose the right.
Does the orphanhood pension pay IRPF?
Public orphanhood pensions are exempt from IRPF. They shouldn't have tax withheld nor be taxable in your income tax return.
Can I apply without Cl@ve or certificado?
Yes. Book an appointment at a CAISS and submit the paper form. Someone with a digital certificado can also file electronically on your behalf.
