Cancel the mortgage in the Registro de la Propiedad (remove the charge)

Energy certificates expire. Without a valid one, the contract may be voided.

If you've already paid off the mortgage, this is the process to remove the charge from the Registro de la Propiedad and leave the property “clean” to sell, inherit or get another mortgage. This is for someone with the loan settled who wants the actual registration cancellation (paying the loan alone is not enough).

  1. 1.Ask your bank for the certificado de deuda cero / carta de pago (via online banking or at a branch). Without this the notary won't cancel.
  2. 2.Go to your notary with the certificate and your DNI so they can prepare and you can sign the escritura de cancelación de hipoteca.
  3. 3.File the Modelo 600 (AJD) at the tax office of your autonomous community marking the exemption for cancellation; if you are in Madrid, do it at https://www.comunidad.madrid/servicios/tributos/modelo-600 and download the receipt (cuota 0€).
  4. 4.Ask the notary to submit the documents electronically to the Registro de la Propiedad (this is the usual route) and to send you the submission receipt; if not, you can present the escritura and the 600 yourself at your Registro.
  5. 5.Pay the registro fee when requested, wait for the inscription (they will notify you) and check the result by ordering an updated nota simple at https://sede.registradores.org/site/propiedad/nota-simple.
