Procedure to open a business in a premises: you submit a declaración responsable or apply for a licencia de actividad at your Ayuntamiento. Use this if you're opening a shop, bar, workshop, hairdresser or similar and need municipal OK.

What you need to have at hand
- Cl@ve PIN/permanent or certificado digital. Without this the sede will kick you out.
- Premises data (exact address and referencia catastral). Get it at https://www.sedecatastro.gob.es.
- Well-defined activity (no vagueness: bar without music, hairdresser, clothes shop…). Requirements change depending on what you declare.
- Technician if needed (architect/engineer) for memoria or proyecto. If you think you can skip it, check before you pay tasas.
Documentation
- ID of the owner (DNI/NIE) and NIF of the company with escrituras and powers.
- Title to the premises: tenancy contract or escritura.
- Measured planos (layout, areas, evacuation) and memoria técnica or proyecto if your activity requires it.
- Compatibilidad urbanística (consulta or prior certificate) if your Ayuntamiento asks for it. Strongly recommended.
- Installation certificates: electrical (boletín), gas if present, HVAC (RITE), PCI (extinguishers, BIEs, detectors) and acoustic study if there is music or noise.
- RC insurance (hospitality, workshops, etc.) and self-protection plan if required by capacity.
- Proof of payment of the tasa municipal (and ICIO if there are works).
Step by step
- Check urban compatibility of the premises. Go to your sede (e.g. Madrid: https://sede.madrid.es; Barcelona: https://ajuntament.barcelona.cat/tramits) and look for “compatibilidad/consulta urbanística”. If it doesn’t exist, at least review the local planning.
- Decide DR or licence: inocuous activities usually go via declaración responsable (immediate). With music, kitchen, risks or public access, you’ll need licencia ambiental and inspection.
- Prepare the memoria/proyecto: plans, fire measures, accessibility, ventilation, waste, capacity and, if needed, an estudio acústico. Don’t underestimate this: a poor report gets rejected.
- Fill in the online procedure: on the municipal sede search “Apertura/Actividad”. Complete details, attach compressed PDFs (<10–20 MB), and sign with Cl@ve/certificado.
- Pay the tasa: the sede usually generates the autoliquidation or payment gateway. Pay and keep the proof.
- Submit and download the receipt. If it’s a DR, you can open from that moment with the receipt visible. If it’s a licence with inspection, wait for the appointment and the resolution.
- If you’re doing works, file the licencia/DR de obras separately and pay the ICIO before starting.
Time-saving tips
- Do the urban compatibility check before renting. It saves a lot if the area doesn’t allow your activity.
- Reuse old licences: if the premises already had the same activity, request a cambio de titular. It’s cheaper and faster.
- Upload signed and compressed PDFs. Sedes choke on large files.
- Have extinguishers and signage installed before inspection. Getting knocked back for that is classic.
- Provide a clear memoria and photos of the premises as they are. Inspectors like things handed to them on a plate.
Common mistakes that can mess up the procedure
- Opening without paperwork: fine + closure. Not worth it.
- Declaring an activity inocua when it isn’t: inspection will catch noise, extraction or capacity issues and you’ll get a tough requirement with tight deadlines.
- Forgetting ICIO if there are works: another fine and a stop order.
- Not planning accessibility: ramps, adapted toilets… If you don’t comply, no licence.
- Exceeding capacity without evacuation justification. The numbers must match the plans.
- Not paying the tasa or not attaching the receipt: they’ll reject or require it and you’ll lose weeks.

- 2.Check urban compatibility of the premises: if the sede offers it, request a consulta previa online; have the referencia catastral handy (you can get it at https://www.sedecatastro.gob.es).
- 3.Prepare the memoria técnica or proyecto (depending on the activity). If your activity is inocua, a memoria with plans may be enough; if there is music, a kitchen, workshops or public access, a proyecto and reports (acoustic, PCI) are usually required.
- 4.Fill in the declaración responsable or licence application in the municipal sede, attach plans, memoria and certificates, and sign with Cl@ve or certificado digital.
- 5.Generate and pay the municipal tasa via your Ayuntamiento’s payment gateway (card or carta de pago) and attach the receipt if asked.
- 6.Submit the procedure and download the receipt. With a declaración responsable you can normally open immediately; if it requires an environmental licence/inspection, wait for the visit and resolution.
- 7.If you carry out works, also process the licencia or declaración responsable de obras and pay the ICIO before starting.
- DNI/NIE of the owner and, if it's a company, NIF and escritura/estatutos (and power of attorney of the signer)
- Title to the premises: tenancy contract or escritura de propiedad
- Measured floor plans of the premises (layout, areas, exits) and an evacuation sketch
- Technical report or proyecto signed by a competent technician with safety, hygiene and accessibility measures
- Certificate/consulta de compatibilidad urbanística of the premises (if your Ayuntamiento requires it)
- Installation certificates: electrical boletín, gas if applicable, HVAC (RITE) and protección contra incendios (PCI)
- Proof of public liability insurance (if your activity requires it: hospitality, workshops, etc.)
- Proof of payment of the municipal fee for the procedure
Opening without a licence/DR can get expensive
Municipal fines for opening without permission can be hundreds to thousands of euros and lead to temporary closure. Also, if an inspection catches you without papers, they can close you on the spot.
Not everything is 'inocua'
Bars with music, kitchens with extraction, workshops or activities with public access usually need a proyecto, acoustic and fire reports, and an inspection. Don’t submit a light DR if it’s not appropriate.
Urban compatibility first
Before signing leases blindly, request a consulta/compatibility check for the premises. If the zoning doesn’t allow your activity, you’ll have wasted your money.
Fees and payments
Most Ayuntamientos require payment of the tasa before registration. Keep the receipt because inspectors will ask for it. If there are works, ICIO is extra.
PDFs and signing
Sedes often cap PDF size (10–20 MB) and fail with huge attachments. Compress plans and always sign with Cl@ve/certificado to avoid repeating the procedure.

Can I open with the declaración responsable without waiting for an inspection?
In many cities yes, for innocuous activities. You submit the DR, pay the tasa and you can open with the receipt on display. They can inspect later; if something is missing, they’ll sanction you.
Can I be fined if I open without licence/DR?
Yes. Fine and closure. The amount varies by ordinance, but it’s not symbolic. If there’s a risk to people (capacity, fires), closure is usually immediate.
Do I need a proyecto signed by a technician?
If your activity involves significant installations (kitchen, extraction, PCI, powerful HVAC) or public access, almost certainly yes. For innocuous activities a memoria técnica with plans may suffice.
How long does it really take?
Declaración responsable is immediate. If your activity needs an environmental licence or prior inspection, count on 1 to 4 weeks (or more if there are requirements).
Is it cheaper to change the licence holder if the premises already had a licence?
Yes, it’s usually faster and cheaper. But only if you keep the same activity and conditions (no works, no changes to machinery/capacity).
Can I process it without certificado digital?
Depends on the Ayuntamiento. You can still do it in-person with an appointment in some towns, but in 2026 nearly everything goes through the sede with Cl@ve or certificado. Companies are usually required to use electronic means.
What if I need to do works before opening?
File the licencia or declaración responsable de obras separately and pay the ICIO. Doing works without permission can bring another fine and delay the opening.
